Terms and Conditions
The following Terms and Conditions constitute an agreement between the Entrants, the Promoter, Centurycomm Limited trading as Racing Post (registered number 3387163) and Trinity Mirror plc, One Canada Square, Canary Wharf, London E14 5AP.
- Competition:
- Select A Cheltenham Stable 2010 fantasy horseracing game.
- Newspapers:
- Racing Post titles, Daily Mirror, Sunday Mirror, Daily Record, The People
- Websites:
- www.racingpost.com, www.mirror.co.uk, www.sundaymirror.co.uk, www.dailyrecord.co.uk, www.people.co.uk
- Entrants:
- Readers of the Newspapers or Websites who make an entry into the Competition
- Materials:
- The text, graphics, photographs, pictures, sounds, digital audio and video clips published in the Newspapers and on the Websites to publicise the Competition
- It is important that Entrants read the Terms and Conditions carefully and understand what they mean. By submitting an entry, Entrants confirm their complete understanding and acceptance of these Terms and Conditions. Centurycomm Limited trading as Racing Post and/or Trinity Mirror Standard Competition Rules apply. Where any conflict exists between Centurycomm Limited trading as Racing Post and/or Trinity Mirror Standard Competition Rules and the Terms and Conditions of the Competition contained herein, the Competition Terms and Conditions shall prevail.
- Entrants must be aged 18 or over on Tuesday March 16 2010.
- All promotional and explanatory Materials, whether published in the Newspapers or on the Websites, form part of the Terms and Conditions.
- Employees of Centurycomm Limited trading as Racing Post, Trinity Mirror plc, CleverTV Ltd, their respective group companies, agents, and members of their families or households are not allowed to enter.
- There is no limit to the number of entries submitted per Entrant, subject to the Terms and Conditions. However each entry must consist of a different selection of horses. The Promoter reserves the right to reject duplicate entries from the same Entrant.
- Entry to the Competition will open on Wednesday 10 March 2010. To score from the first day, entries must be received no later than 1.30pm GMT on Tuesday 16 March 2010. Entries will remain open for the daily prizes up to 1.30pm on Friday 19 March 2010. The deadline for daily entries will be 1.30pm on each day. Entries will score points from when they are entered. Points will not be backdated from previous days.
- Inaudible, unintelligible, incomplete or incorrect entries, or any considered inappropriate, offensive or obscene will be regarded as invalid and the entry rejected. Centurycomm Limited trading as Racing Post, Trinity Mirror plc and CleverTV Ltd will not be held responsible for entries lost or distorted in transfer, or for network breakdowns that result in an entry not being registered or confirmation not being received. Proof of magnetic transcript and/or posting is not accepted as proof of entry.
- Acceptable methods of entry into the Competition:
- Online via the Websites. Payment to be made by the Entrant using a valid credit/debit card. Cost per entry £5.00. Entrants entering online will also incur their own cost (if any) of time spent accessing the internet.
- Telephone via the Competition hotlines published in the Newspapers. Entry via telephone line is available in the UK only. Entrant to be charged £1.00 per minute. Estimated call duration is five minutes. Call charges based on BT landlines. Calls from other networks, mobiles and payphones may vary.
- Post via the official Game coupon published in the Newspapers. Payment to be made by the Entrant by enclosing cheque or Postal Order for the required amount, made payable to 'Clever TV Ltd'. Postal entries must be received by first post on Monday 15 March 2010 to be valid for the competition.
- The Promoter may from time to time offer Website Entrants discounts and special promotions at its sole discretion. To qualify for discounts and special promotions, Entrants must comply with the offer conditions.
- Entry fees are non-refundable.
- Each entry entered into the Competition must contain 12 horses; 2 Bankers, 4 Strong Fancies, 4 Good Chances and 2 Outsiders. Horses cannot appear in the same entry more than once. Only the official Competition list of horses published on the Websites and in the Newspapers applies. The Promoter will not enter into any correspondence in this regard.
- A unique 12-digit PIN number will be supplied for each internet and phone entry correctly entered into the Competition. It is the Entrant's responsibility to ensure retention of their PIN(s) which may be required for login and security. Website Entrants will receive their PIN(s) via a confirmation email delivered to the email address supplied during registration, Telephone Entrants via a voiced acceptance message on conclusion of registration. In the event Entrants lose their PIN(s) a telephone helpline will be in operation throughout the Competition on UK: 0843 1680 201* — ROI: 0044 843 1680 201*.
- Should any of the horses in the official horse list run in more than one Race at the Cheltenham Festival, points will be awarded for performance in both Races.
- Points are based on every race scheduled for the Cheltenham Festival (16-19 March 2010). If races are rescheduled for subsequent days, they will remain as part of the competition and as their scheduled day. For example, if Wednesday's races are postponed and run on Thursday, they will count as part of the competition and will be listed as taking place on Wednesday. Wednesday's daily prize and all other daily prizes will be awarded in accordance to the races scheduled for that day - regardless of when they are actually run.
- Horses will score points for finishing in the top six of the scheduled races as follows: winner will score 10pts; 7pts for second place; 6pts for third place; 5pts for fourth place; 4pts for fifth place; 3pts for sixth place. Horses failing to complete the course will score -2pts. Banker selections score double points. If a horse on the horse list does not run in any race, a score of zero will be awarded. Bonus points will be awarded to the winner depending on the published Starting Price:
Published Starting Price Points Up to 2-1 = 1pt Over 2-1 and up to 3-1 = 2pts Over 3-1 and up to 4-1 = 3pts Over 4-1 and up to 5-1 = 4pts Over 5-1 and up to 8-1 = 5pts Over 8-1 and up to 12-1 = 6pts Over 12-1 and up to 20-1 = 7pts Over 20-1 = 10pts - If any of the winning Starting Prices are impacted by Rule 4 deductions, these will also apply to the Starting Price bonus. In the event of a dead-heat for one of the first six places in any Race in the Competition, both horses will score full points for the places involved.
- The Promoter will update the game statistics on the Websites after racing on 16, 17, 18, and 19 March 2010, updates on horses with points will also be printed in the Newspapers on 17, 18, and 19 March 2010. A final leaderboard and details of prize winners will be published on Saturday 20 March 2010.
- There are unlimited horse substitutions allowed in the Competition, which must be made no later than 1.30pm GMT on Tuesday 16 March 2010. Substitutions for online/phone entrants can be made by following the instructions on the Website or by calling UK: 0843 1680 202* — ROI: 0044 843 1680 202*.
- Coupon Entrants cannot make any substitutions to their selected stables. Postal entrants CANNOT make substitutions via internet or phone.
- The first prize will be awarded to the entry which accumulated the most points from the Races during the Competition. Additional prizes will be awarded in accordance with finishing positions on the overall leaderboard. None of the prizes will be shared. In the event of a tie on points between entries for any prize, the prize will be awarded on the principle of a countback to the entry with the higher number of winners; or, if necessary, seconds, or thirds and so on. In the unlikely event of a further tie, the Promoter will consider first the Starting Price of horses in each tied entry, then finishing distances and finally the time of entry (earliest take the higher position) will be used to determine a unique winner for each prize.
- Prizes will be awarded only in accordance with the Prize Fund detailed from time to time on the Websites and in the Newspapers. 1st: £15,000; 2nd: £1,000; 3rd: £500; 4th: £300; 5th: £200; Most points gained on day 1: £2,000; Most points gained on day 2: £2,000; Most points gained on day 3: £2,000; Most points gained on day 4: £2,000;
- Winners of all prizes will be notified within 28 days of the end of the Competition. Winners will be notified via email or telephone. All winners are required to co-operate with the Newspapers' photographers or reporters to publicise their win as Centurycomm Limited trading as Racing Post and/or Trinity Mirror plc and/or the Promoter deems appropriate. Failure to comply with this rule may result in disqualification of the entry.
- Competition Entrants who are connected to and registered with the Vodafone, T-Mobile, O2, Orange, Hutchison3G UK cellular phone networks and Vodafone, Meteor and O2 ROI cellular networks may subscribe to receive an SMS update on their mobile phones reporting entry performance and the overall leader score by completing the SMS registration procedure to the satisfaction of the Promoter. The SMS update is available at a maximum cost of 25p per update (including VAT), which will be debited against the Entrant's registered mobile phone account. You may unsubscribe from the update service at any time by either updating your personal details on the relevant page of the Websites or by sending STABLE STOP to 83010 (to stop all messages from this number) from your mobile phone. You may also email the helpdesk and ask SMS alerts to be stopped. The Promoter reserves the right to suspend or cancel the provision of the SMS update without notice and for any reason.
- The Promoter and Centurycomm Limited trading as Racing Post and/or Trinity Mirror plc have made all reasonable endeavours to ensure that the Competition is provided using reasonable skill and care. However, no warranties are made whatsoever in relation to the accuracy, suitability, reliability, completeness or otherwise of the Competition itself nor in relation to disruptions, delays or errors in connection with the Websites or the internet, in particular for any acts or omissions made by any telecommunications service provider with whom you have contracted to gain access to the Websites, all to which without limitation The Promoter and Centurycomm Limited trading as Racing Post and/or Trinity Mirror plc accepts shall not be held responsible. Further, no warranty is made in respect of information to which you may have access but which has not been directly provided by the Promoter and/or Centurycomm Limited trading as Racing Post and/or Trinity Mirror plc, including without limitation, information on the internet available outside of the Websites which shall remain the responsibility of the provider of such information.
- Except as expressly provided in these Terms and Conditions, and to the extent permitted by law, Centurycomm Limited trading as Racing Post, Trinity Mirror plc, its employees, agents and partners disclaim any and all liability in respect of any loss or damage arising out of the Competition, Newspapers and/or Websites, whether such loss or damage results from negligence, breach of statutory duty or otherwise, and whether in contract or in tort or otherwise, including but not limited to the loss or corruption of data, any errors or omissions, content, delays or interruptions in transmission or operation and lines or communication failure. In no event shall the Promoter, Centurycomm Limited trading as Racing Post and Trinity Mirror plc be liable for any loss of profit, goodwill and any indirect, special or other consequential or incidental damage, whether foreseeable or not.
- In the event that any liability does arise then the liability of Centurycomm Limited trading as Racing Post and/or Trinity Mirror plc and/or the Promoter whether in contract, tort or at law shall be limited in aggregate to the money paid by the relevant Entrant in lieu of registration to play the Competition.
- Without limitation all of the Competition Materials in the Newspapers and on the Websites is the exclusive property of Centurycomm Limited trading as Racing Post/Trinity Mirror plc and/or of the companies who may have supplied such Materials to Centurycomm Limited trading as Racing Post/Trinity Mirror plc. The Material, including compilation, selection, presentation and arrangement thereof, is protected by national laws and international agreements on copyright, moral rights, and other intellectual property rights.
- Entrants may not modify, reproduce, distribute, exchange, sell or transmit any of the Material, nor store it in any form (whether tangible or electronic). Copying or downloading materials for any business, commercial or public purpose is strictly forbidden. Civil or criminal liability may result from any use in contravention of this clause. The Competition's name and logo, and any other graphics, logos and trademarks used in the Newspapers or on the Websites are protected by laws and international agreements on intellectual property. None of the trademarks may be used in association with the products or services of a third party or in a manner which could, either directly or indirectly, defame or discredit us or a third party. All trademarks and trade names appearing on the Website (including names or products belonging to third parties) remain entirely the intellectual property of the Promoter or Centurycomm Limited trading as Racing Post or Trinity Mirror plc or the intellectual property of their respective owners (as the case may be).
- The Promoter, Centurycomm Limited trading as Racing Post and Trinity Mirror plc reserve the right, at both parties sole and absolute discretion, to rule on any unforeseen circumstances or circumstances beyond our control in whatever way the Promoter and/or Centurycomm Limited trading as Racing Post and/or Trinity Mirror plc deem most appropriate (including the cancellation or postponement of the Competition or changes to these Terms and Conditions) in order to reach what is either party considers to be an equitable solution for the Entrants to the Competition. The Promoter and/or Centurycomm Limited trading as Racing Post and/or Trinity Mirror plc's decision will be announced on the Website as soon as reasonably practicable after such decision has been reached. No correspondence will be entered into by the Promoter, Centurycomm Limited trading as Racing Post or Trinity Mirror plc in respect of such decision which will be final and binding in all respects.
- Neither the Promoter, Centurycomm Limited trading as Racing Post nor Trinity Mirror plc shall be liable for its failure fully to perform their obligations under this Agreement if and to the extent that such failure is due to reasons of force majeure or change in laws or regulations or any other occurrence beyond either parties reasonable control.
- These Terms shall be governed by and interpreted in accordance with English law and Entrants hereby submit to the exclusive jurisdiction of the English courts in connection with any dispute that may arise regarding any aspect of the Competition or the Terms.
